By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Academy of Road Safety - ABN 78 165 345 853.

Academy of Road Safety reserves the right to update and change the Terms of Service without notice.

Services

Academy of Road Safety provides training and assessment services in accordance with applicable Registered Training Organisation (RTO) standards. All services are subject to availability and may be modified, suspended, or discontinued at any time without liability.

Enrolment and Eligibility

Enrolment is subject to acceptance at the sole discretion of Academy of Road Safety
You must provide accurate, complete, and current information
Academy of Road Safety reserves the right to refuse, suspend, or terminate enrolment at any time

Fees, Payments and Debt Recovery

All fees are payable in Australian Dollars (AUD)
Payment terms are agreed at enrolment and must be strictly adhered to
Failure to pay fees may result in:
- Immediate suspension of access to training and assessment
- Cancellation of enrolment without refund

Debt Recovery

Where fees remain unpaid:

All outstanding amounts become immediately due and payable
Academy of Road Safety may engage a debt collection agency
You agree to be liable for all reasonable recovery costs, including legal fees and administrative charges
Unpaid debts may be reported to credit reporting agencies where permitted by law

Chargebacks

You agree not to initiate chargebacks or payment disputes without first attempting to resolve the matter directly with Academy of Road Safety.

Cancellation and Refund Policy

Training services are structured with fees payable upon completion; therefore, refund eligibility is limited.

Administrative Fee

A non-refundable administrative fee starting from $550 applies to all withdrawals. This may vary depending on the level of progress and processing required.

Withdrawal Fees (Online Course Progress)

If you withdraw from the course:

Up to 25% completed: $500 + administrative fee
Up to 50% completed: $1,000 + administrative fee
Up to 75% completed: $1,500 + administrative fee

Practical Training

If the practical component has been completed, the full course fee applies and no refund will be issued.

Lesson/Booking Cancellations

Less than 24 hours’ notice: full session fee forfeited
No-shows: treated as late cancellations and fully forfeited

Refund Conditions

Refunds are not automatic and must be requested in writing
Approved refunds will be processed within a reasonable timeframe
Any eligible amount may be applied as account credit at the discretion of Academy of Road Safety

Provider Changes

Academy of Road Safety may cancel or reschedule training due to operational requirements. In such cases, a suitable alternative or refund for the affected component will be offered.

Price Match Guarantee

Academy of Road Safety may, at its discretion, match and beat by $100 a lower price offered by another Australian Registered Training Organisation for an identical course.

Conditions:

The course must be identical in qualification, delivery, and duration
Proof must be verifiable and current
Claims must be submitted prior to course commencement or within 7 days of enrolment
Excludes promotions, discounts, or limited-time offers

Academy of Road Safety reserves the right to approve or reject claims.

Vouchers, Credits and Transfers

Vouchers are non-refundable and not redeemable for cash
Vouchers and credits are not transferable between individuals
Credits may expire if not used within a reasonable timeframe
Academy of Road Safety reserves the right to determine the application of credits

Behaviour and Conduct

You must not engage in abusive, threatening, unsafe, or inappropriate behaviour.

Academy of Road Safety may:

Remove you from training sessions
Suspend or terminate your enrolment
Refuse future service

No refund will be provided in such cases.

Intellectual Property

All materials, content, and resources remain the property of Academy of Road Safety. Unauthorised reproduction, distribution, or use is strictly prohibited and may result in legal action.

Website and Service Use

You agree not to:

Use the website for unlawful purposes
Submit false or misleading information
Interfere with or disrupt the service

Academy of Road Safety reserves the right to suspend or terminate access for any breach.

Limitation of Liability

To the maximum extent permitted by law:

Academy of Road Safety excludes all liability for indirect, incidental, or consequential loss
Academy of Road Safety does not guarantee uninterrupted or error-free services
You use the website and services at your own risk

Indemnity

You agree to indemnify and hold harmless Academy of Road Safety, its staff, contractors, and affiliates from any claims, damages, losses, or expenses arising from:

Your breach of these Terms
Your misuse of services
Your participation in training activities

Privacy and Data Use

Academy of Road Safety collects and uses personal information in accordance with applicable privacy laws and regulatory requirements, including reporting obligations.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Australia. You submit to the exclusive jurisdiction of the courts within Australia.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Account Terms

This page contains the most current version of the Terms of Service.

You agree that Academy of Road Safety can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
You are responsible for maintaining the security of your account and password. Academy of Road Safety cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
By purchasing from Academy of Road Safety, you agree not to initiate any credit card chargeback, or dispute any payment made for services, products, digital goods, Vouchers or gift cards purchased, except in cases of proven fraud or unauthorized transactions. All disputes must be resolved directly with Academy of Road Safety.
You must not post or submit false information to the Service.
You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
You are responsible for all activity that occurs from your account.
Accounts registered by "bots" or other automated methods are not permitted and will be removed.
Academy of Road Safety has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Academy of Road Safety service, for any reason.
Violation of any of the terms or general conditions may result in the termination of your Account.
In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Academy of Road Safety has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Academy of Road Safety service. Such termination of the Service will result in the deactivation of your Account.

Cancellation Rates

Less than 24 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Academy of Road Safety.

Refund Policy

Our training and assessment programs attract fees payable according to the agreed course terms. If a participant chooses to cancel their enrolment, a standard administrative fee of $550 will apply, adjusted according to the number of units already completed. As course fees are payable upon completion, eligibility for refunds is limited.

Modifications to Services and Prices

Academy of Road Safety reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
Prices of all Services are subject to change with or without notice.
Academy of Road Safety shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Vouchers

Vouchers are non-refundable and cannot be redeemed for cash.
Unused vouchers cannot be transferred between clients.

Fees

Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Academy of Road Safety for payment processing.
All fees and transactions are in Australian Dollars.

General Conditions

Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Academy of Road Safety.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Academy of Road Safety customer, employee, member, staff, officer or external contractor will result in immediate account termination.
You must not transmit any worms or viruses or any code of a destructive nature.
You understand that Academy of Road Safety uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
Academy of Road Safety does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
You expressly understand and agree that Academy of Road Safety shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Academy of Road Safety has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
